I have the honour to acknowledge the receipt

of your despatch No.216 of the 15th of July, 1926, enclosing

a copy of a despatch of 12th July addressed to the High

Commissioner, Federated Malay States, concerning the

interpretation of the phrase "with effect from" or "as from

when used in notifying the date of retirement of Government

officers.

In the second paragraph of your despatch of 12th July you explain that you had proposed to continue the practice under which, when notifying the retirement of an

officer with effect from a certain date, it was your

intention that he should receive leave salary up to and

including that date.

That this was not the invariable practice of

the Colonial Office will be seen from the letter 19394

Eastern of 15th January, 1926, calling upon Mr. A. R.

Cavalier to retire "with effect from the 1st of February", for it was presumably intended that 1st February should be

the first day of pension.

I regret that it is not clear to me what meaning is intended to be conveyed by the addition in future of the word "inclusive", which, you explain, "will involve

an alteration in the present practice".
